Innovation protection and technology transfer

Innovationen in den Life Sciences stehen in einem Spannungsverhältnis zwischen Schutz von geistigem Eigentum einerseits und der Gewährung von Zugang zu diesen Innovationen im Sinne einer Open Innovation andererseits. Neben Lizenzverträgen gibt es im Bereich der Life Sciences weitere Möglichkeiten des Technologietransfers, so etwa im Rahmen von Patent Clearing Houses und anderen Plattformen. Dabei stellen sich spezifische Fragen der rechtlichen Ausgestaltung im Hinblick auf genetisches Material und Sequenzinformationen.

Innovations in the life sciences are caught between the protection of intellectual property on the one hand and the facilitation of access to these innovations in the sense of open innovation on the other. In addition to licensing agreements, there are other possibilities for technology transfer in the life sciences, for example within the framework of patent clearing houses and other platforms. This raises specific questions about the legal structure with regard to genetic material and sequence information.
